These Terms and Conditions ("Terms") govern your use of gifmememaker.com, including our meme maker studio, templates and related features (collectively, the "Service"). By using the Service you agree to these Terms. If you do not agree, please do not use the Service.

1. Use of the Service

gifmememaker.com grants you a limited, non-exclusive, non-transferable, revocable licence to use thefree meme maker for personal and commercial meme creation, subject to these Terms. The Service is provided "as is" and "as available" without warranty of any kind.

2. Eligibility

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Service. By using it, you confirm that you meet this requirement and have the capacity to enter into a binding agreement.

3. Acceptable Use

You agree not to use the meme maker to create, upload or distribute content that:

• is illegal, or promotes violence, harassment, hate or exploitation of any person or group;
• infringes copyright, trademark, publicity or privacy rights you do not own or licence;
• is defamatory, fraudulent, or deliberately misleading in a way that causes harm;
• contains malware, or is intended to disrupt, reverse-engineer or overload the Service; or
• violates the terms of any platform where you post the resulting memes.

We may suspend or block access to the Service for anyone who abuses it, to the extent technically possible for a fully client-side tool.

4. Your Content and Copyright

You keep full ownership of the images, GIFs, videos and text you upload or create ("Your Content"), and of the memes you export. Because processing happens in your browser, we never receive or claim any licence to Your Content.

You are solely responsible for having the rights to use everything you put into theonline meme maker. Uploading someone else's photo, artwork, clip or music without permission may infringe their rights — get permission, use licensed or public-domain material, or rely on legitimate fair use/fair dealing where it applies. Meme culture frequently references existing characters and media; transformative, non-commercial meme use is often tolerated by rights holders, but only you can judge the risk for your specific case.

5. Templates, Fonts and Brand Assets

The templates, UI design, logos (including the ghost mark), fonts bundled for the editor and other assets we provide are licensed to you for use inside your memes. You may not resell, rebrand or redistribute the raw templates, the editor itself, or our brand assets as your own product. Third-party fonts and media included with templates remain subject to their original licences (for example, the SIL Open Font Licence for the Google Fonts we load).

6. Free and Pro Features

Core features of the meme maker free tier — image, GIF and video editing, templates, trimming, speed control, AI captions and standard exports — are provided at no cost. Optional Pro features (4K stills, MP4/WebM export, watermark removal) may require payment. We may modify, add or remove features at any time; the pricing and feature set shown at the time of purchase apply to that purchase. Fees already paid are non-refundable except where required by law.

7. Disclaimers

The Service is provided without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that theAI meme maker will generate captions you like, that exports will be uninterrupted or error-free, or that the Service will meet every requirement of yours.

8. Limitation of Liability

To the maximum extent permitted by law, gifmememaker.com and its operators shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits, goodwill or business opportunity, arising from or related to your use of (or inability to use) the Service. Our total aggregate liability shall not exceed the greater of the amount you paid us in the twelve months before the claim arose, or USD $50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

9. Indemnity

You agree to indemnify and hold harmless the operators of gifmememaker.com from claims arising out of Your Content or your misuse of the Service, including violations of third-party rights or of these Terms.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with a revised "Last updated" date. Continuing to use the meme maker app after changes take effect means you accept the updated Terms.
